Terms of Organizational Self-Assessment

Definitions:

  • "ansoim": Refers to ansoim LLP, its partners, employees, and agents.

  • "User": Refers to the individual or entity participating/completing the self-assessment.

  • "Self-Assessment": Refers to the Organizational Maturity Self-Assessment provided by ansoim.

  • "Assessment Report": Refers to the report generated based on the data submitted by the User in the Self-Assessment.

  • "Website": Refers to www.ansoim.com.

Parties:

  • ansoim LLP (hereinafter referred to as "ansoim")

  • User (hereinafter referred to as "You"

 

 

Terms:

  • Process: The Organizational Self-Assessment will be conducted online using ansoim's organizational self-assessment model. VC or telephonic conversations can be arranged to clarify User queries.

  • No Guarantee or Warranty: ansoim does not guarantee or warrant the accuracy or completeness of the Self-Assessment or the resulting Assessment Report. The assessment is based on User-provided insights; hence, ansoim has no role in determining the accuracy of inputs or User insights.

  • Confidentiality:

    • Your privacy is of utmost importance to us. By submitting the Self-Assessment, You agree to maintain the confidentiality of the assessment process, elements, and content.

    • By participating in the Self-Assessment, You agree that ansoim may showcase you as a client on its Website and other mediums. ansoim will not disclose/share your inputs or your assessment report with anyone.​

  • Non-Disclosure Agreement (NDA):​

    • Confidential Information: Both parties acknowledge that during the course of the Self-Assessment, they may have access to confidential information belonging to the other party. Confidential information includes, but is not limited to, business strategies, financial data, operational processes, proprietary methodologies, trade secrets, and any other information that is not publicly known and is designated as confidential by the disclosing party

    • Obligations: Both parties agree to:

      • Keep all confidential information strictly confidential and not disclose it to any third party without the prior written consent of the disclosing party.

      • Use the confidential information solely for the purpose of conducting the Self-Assessment and generating the Assessment Report.

      • Take all reasonable precautions to protect the confidentiality of the information.

      • Ensure that any employees, agents, or subcontractors who have access to the confidential information are bound by similar confidentiality obligations. However, cyber security risks are constantly evolving, and ansoim cannot guarantee the absolute security of your data. It is not responsible for any data breaches or other security issues that may occur.

    • Exclusions: Confidential information does not include information that:

      • Was in the public domain at the time it was disclosed or has entered the public domain through no fault of the receiving party.

      • Duration: The confidentiality obligations set forth in this NDA will remain in effect indefinitely, even after the completion of the Self-Assessment and the delivery of the Assessment Report.

  •  Fees and Charges:

    • The charges for the Organizational Self-Assessment will be displayed on the offer page.

    • ansoim reserves the right to change the charges without any prior notice, however changes will not have any retrospective effect post payment by client.

    • Once paid, the charges are non-refundable.

    • However, dissatisfied clients can claim a money-back refund of up to 30% of the charge paid. Any taxes paid will not be refundable.

  • Indemnity: You agree to indemnify and hold harmless ansoim and its partners, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from Your use of the Self-Assessment and the resulting Assessment Report.

  • Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

  • No Liability: You agree that You will not seek any damages or compensation of any nature from ansoim, its partners, employees, or agents in connection with Your use of the Website or Self-Assessment or the resulting Assessment Report.

  • No Challenge: You agree not to challenge any aspect of this service, including the Self-Assessment process, the resulting Assessment Report, or the terms and conditions outlined herein.

  • Terms of Website Use: Applicable.

  • Privacy Policy of Website Use: Applicable.

  • Jurisdiction: Any disputes arising from these terms will be governed by Indian law and will be subject to the jurisdiction of the Kolkata High Court.

  • Eligibility: You must be at least 18 years of age or over the legal age to use our Website, read, understand, and accept our "Terms of Website Use," participate in the Self-Assessment, and read, understand, and accept our "Terms of Self-Assessment." This ensures that our service is used responsibly and by those who can fully understand and accept our terms.

  • By submitting this Self-Assessment, You acknowledge that You have read, understood, and agree to these terms and conditions.
